Eighth Circuit Affirms Summary Judgment

The Eighth Circuit Court of Appeals recently affirmed summary judgment in favor of an Arkansas hospital and a number of physicians (who had served in various capacities on hospital boards and committees, including hospital peer review committees).  The plaintiff in the case, also a physician, had filed suit alleging that termination of his hospital privileges had been racially motivated.  As stated in the opinion, “[The plaintiff] filed the instant suit in federal district court alleging, inter alia, race discrimination and retaliation, in violation of 42 U.S.C. § 1981 and the ACRA, and conspiracy to violate his civil rights, in violation of 42 U.S.C. § 1985(3).”  The United States District Court for the Eastern District of Arkansas granted summary judgment in favor of all defendants, including a physician represented by Overton S. Anderson and David Littleton.  The opinion is available here.
